MarkGuard

Terms of Service

Last updated: 31 October 2026

These terms cover the MarkGuard website, free checker, Chrome extension and MarkGuard Pro subscription ("MarkGuard"), provided by 5parmak. By using MarkGuard you agree to them.

What MarkGuard does

MarkGuard compares text you give it (listing titles, tags, descriptions) with a copy of the public US trademark register and points out words and phrases that match live registrations. It is an information tool.

Not legal advice

MarkGuard does not give legal advice and does not tell you whether a use is lawful. Results can be incomplete, out of date or wrong: a listing MarkGuard marks as clean can still infringe a trademark or copyright, and a flagged word can be perfectly fine to use. MarkGuard checks US word marks only. It does not check images, logos, designs, copyrights or registers of other countries. You are responsible for what you list and sell. For legal questions, consult a qualified attorney.

Acceptable use

Do not use MarkGuard to overload or scrape the service, to get around usage limits, or for anything unlawful. We may limit or block access that does.

Availability and changes

We work to keep MarkGuard available and the data current, but we do not guarantee uninterrupted service. We may change or discontinue features. If we discontinue Pro, we will refund the unused part of any prepaid period.

Liability

MarkGuard is provided "as is". To the extent the law allows, 5parmak is not liable for indirect or consequential losses, including lost sales, takedowns, account suspensions or legal claims related to your listings. Our total liability is limited to the amount you paid for MarkGuard in the 12 months before the claim.

Changes to these terms

We may update these terms. If a change matters, we will note it on this page and, for Pro customers, by email.
